Terms of Service
1. Acceptance of Terms
By accessing or using MyAgentMail ("Service"), operated by MyAgentMail ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
MyAgentMail provides email infrastructure APIs for AI agents, including email sending, receiving, IMAP/SMTP access, and domain management. The Service is intended for transactional and programmatic email use only. The LinkedIn outreach module, when subscribed, is governed by a separate LinkedIn Module Terms of Service.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your API keys and account credentials. You must be at least 18 years old to use the Service.
4. Acceptable Use Policy
MyAgentMail is transactional email infrastructure, not a marketing relay. The following uses are strictly prohibited. We monitor for these patterns and enforce them automatically; suspected violations lead to immediate suspension without prior notice.
4.1 Prohibited content and senders
- Phishing, malware, and deception. Emails containing phishing links, malware payloads, fraudulent payment requests, or content designed to deceive recipients.
- Brand impersonation. Sender local-parts, display names, sender domains, or message content that impersonates another person, company, government agency, financial institution, telecom, courier, or any third-party brand you do not own. Inbox addresses such as
paypal-*,sars-*,capitec-*,dhl-*,vodacom-*, or similar are automatically blocked at provisioning; the broader prohibition extends to all content within messages. - Unsolicited bulk email. Marketing emails, newsletters, cold-list outreach, or any messaging not triggered by a recipient action or pre-existing business relationship.
- Non-opted-in recipients. Sending to purchased, scraped, harvested, or guessed email addresses; sending to any address that has not explicitly consented to receive the type of communication you are sending.
- Mass identical-content sends. Sending the same or substantially similar subject line and body to large numbers of recipients within a short window. This pattern is characteristic of spam and phishing campaigns regardless of intent.
- Programmatic mass provisioning. Creating inboxes or domains at industrial scale (e.g. dozens of inboxes within minutes) for the purpose of evading per-account sending limits or distributing a single sender's identity across many addresses.
- Anything illegal where you, your recipients, or your business operates. Including but not limited to violation of POPIA (South Africa), GDPR (EU/UK), CAN-SPAM (US), CASL (Canada), PDPA (Singapore), or any successor or equivalent legislation.
- Circumvention of safeguards. Attempting to bypass rate limits, sending limits, suppression lists, bounce-rate thresholds, complaint thresholds, address validation, or any other technical or contractual safeguard.
4.2 Deliverability thresholds (enforced automatically)
- Inbox bounce rate must remain below 5% over a rolling window (minimum 20 sends required for enforcement). Inboxes that cross this threshold are auto-paused.
- Inbox spam-complaint rate must remain below 0.1% over the same window.
- Trial accounts are limited to 10 outbound emails per day and 10 LinkedIn actions per day, regardless of paid-plan ceilings, until the trial converts to a paid plan via Stripe checkout.
- New accounts under 7 days old face additional throttling beyond their plan's nominal limits to build sender reputation.
4.3 Enforcement and cooperation with partners
We reserve the right, without limitation, to:
- Suspend or terminate accounts that violate this policy immediately, without notice, without refund. Suspended accounts have all API keys, inboxes, custom domains, and LinkedIn sessions disabled simultaneously.
- Share signup metadata (email, IP address, user-agent, country), payment method fingerprint, and abuse-event history with our payment processor (Stripe), email-relay providers (Amazon SES, Zoho ZeptoMail), and reputation networks (Stripe Radar, anti-fraud feeds) to prevent recurrence.
- Report illegal activity — including phishing, fraud, and identity impersonation — to relevant law-enforcement authorities, brand owners, and data-protection regulators in any affected jurisdiction.
- Recover from you any fees, fines, chargebacks, abuse-related credits, or reputational remediation costs incurred by us as a direct result of your violation.
- Preserve evidence of abuse — including a full record of sends, recipients, and metadata — for investigation by us, our partners, or competent authorities.
We do not provide notice prior to suspension for AUP violations. The first communication you receive from us in response to a suspected violation may be the suspension itself, accompanied by a request for explanation or a final-termination notice.
5. Email Sending Requirements
All outbound emails must be sent to verified or opted-in recipients only. You must pass verified: true in the API to assert recipient validity; doing so represents an affirmative warranty that the recipient has consented to receive the message. We enforce MX record validation on all outbound emails and apply automated validation of recipient deliverability (via Amazon SES Auto Validation or equivalent). Inboxes that exceed bounce or complaint rate thresholds are automatically paused; resumption requires opening a support ticket and demonstrating list-hygiene remediation.
6. Service Levels and Limits
Your plan determines your inbox, email, and domain limits. Exceeding limits will result in API requests being rejected (HTTP 403). We reserve the right to modify plan limits with 30 days notice.
7. Payment and Billing
Paid plans are billed monthly via Stripe. You authorize us to charge your payment method on file. Refunds are not provided for partial months. If payment fails, your account may be downgraded to the trial plan after a 7-day grace period.
8. Data Ownership
You retain ownership of all email content sent and received through the Service. We do not sell, share, or use your email content for any purpose other than providing the Service. We may retain email metadata (sender, recipient, timestamps) for analytics and abuse prevention.
9. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for delays, failures, or data loss caused by factors beyond our control. Scheduled maintenance will be communicated in advance when possible.
10. Limitation of Liability
To the maximum extent permitted by law, MyAgentMail's total liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
11. Termination
Either party may terminate at any time. Upon termination, your API keys will be deactivated and email data will be deleted within 30 days. We may terminate accounts that violate these terms immediately without refund.
12. Changes to Terms
We may update these terms at any time. Material changes will be communicated via email to your registered address. Continued use of the Service after changes constitutes acceptance.
